What Makes DWIs So Challenging In Pflugerville

Pflugerville is located mostly in Travis County, but has a portion in Williamson County as well. Each county has its own approach on how it handles DWI cases – and the stakes you face may depend upon where your arrest happened. It is extremely important that your Pflugerville DWI attorney knows how to proceed no matter where you were stopped.

Our DWI lawyers have practiced extensively in both Travis County and Williamson County, handling DWI cases in both locations. We have made appearances in both the Travis County Blackwell-Thurman Criminal Justice Center and Williamson County Justice Center.

How DWIs Work In Pflugerville

Police need to have reasonable suspicion to make a traffic stop, which means that they have to have a belief that a law is being broken. In many cases, this is some sort of traffic infraction, like speeding or weaving between lanes, which then leads police to pull a motorist over and continue the investigation. These stops may be made by local Pflugerville Police Department officers, Texas Highway Patrol officers, or Travis or Williamson County Sheriff’s officers.

During the traffic stop, the law enforcement officer is checking the driver for signs of impairment. This can be slurred speech or the smell of alcohol on the driver’s breath. If alcohol or drugs are present, the officer may also begin to move on to the next step in the process, which is field sobriety tests.

Drivers can refuse field sobriety tests, but if they do so, they can most likely expect to be arrested for DWI. After an arrest, the state’s implied consent laws require the motorist to submit to a breath or blood test to check a person’s level of impairment.

After all the evidence is collected and analyzed, the case will be referred to prosecutors at the Travis County District Attorney’s office or Williamson County District Attorney’s office, depending upon where the stop occurred and the arresting agencies involved. The DA will determine if charges should be brought against a motorist who has been arrested for DWI.
